Terms and Conditions of Sale

These General Terms and Conditions of Sale (“GTC”) govern online purchases made on the website www.devidlabel.com.

The seller is:

(hereinafter "Devid Label")

Users are invited to carefully read these GTC before making a purchase on the website.

1. Conclusion of the contract and product delivery

Every order placed on www.devidlabel.com constitutes a distance sales contract between the customer and M.A.R.E. SRL.

By clicking the “Purchase” button, the customer places a binding order for the products in the cart. Once the order is submitted, Devid Label will send the customer an order confirmation email within 1 hour. The sales contract is considered concluded when the customer receives this confirmation.

If the customer does not receive any confirmation within the specified timeframe, the order shall be considered rejected and without effect.

For orders with advance payment, shipping will only occur after the actual receipt of the full amount due, including any shipping costs. The customer is invited to make the payment within 7 days of receiving the order confirmation.

The buyer gives their prior consent to the possible assignment to third parties, in particular to Scalapay and Klarna, of pro soluto credits relating to the payment of the purchase price.

In the event that the ordered products are not available due to reasons beyond Devid Label’s control, the customer will be promptly informed. In such a case, Devid Label will not be obliged to deliver the goods and will promptly refund any sums already paid.

Devid Label is not obliged to procure missing products from other suppliers. The delivery obligation applies exclusively to items available in stock or already ordered from its suppliers.

If delivery times are expressed in working days, this refers to Monday to Friday, excluding public holidays.

2. Prices, shipping costs and delivery

The customer is required to pay the price published on the product page at the time of placing the order. All prices are inclusive of VAT.

Shipping Italy

 

  • Orders shipped with InPost: always free

  • Orders over €99.00 : free - home delivery

  • Orders up to €99.00:

    • €5.90 with Standard courier - home delivery 

  • Express delivery: always €9.90 with Premium courier

Shipping Europe

For orders over €149.00, shipping is free.
For lower amounts, the cost is calculated based on the destination country and shown at checkout.

Cash on Delivery

Cash on delivery is a paid ancillary service, with a flat fee of €6.00.

This type of delivery requires the customer to:

  • confirm address and availability by phone or email

  • prepare the exact amount in cash

  • be present at the time of delivery

If the customer is unavailable after purchase, the order may be unilaterally cancelled. In case of failure to collect the goods, resulting in storage and return costs, Devid Label reserves the right to request payment of a penalty equal to €25.00.

Exchanges and returns Italy

  • For orders with a value below €99.00:

    • exchange: €7.90

    • return: €9.90

  • For orders with a value above €99.00:

    • free exchange

    • free return

From May 31, 2024, in case of returns of orders paid by cash on delivery, a voucher of equal value, valid for 6 months, will be issued, net of any incurred expenses.

Exchanges and returns Europe

For orders of any amount, the cost of handling exchanges/returns is €25.00 per trip.

Exchanges and returns rest of the world

For non-EU orders, it is necessary to contact customer service at resi@devidlabel.com to inquire about specific costs for the destination country.

Any subsequent size exchanges and/or further returns will always incur a charge and will be invoiced at €25.00, upon confirmation from the company.

Disadvantaged / remote locations

Additional shipping or return costs may apply for certain destinations. The customer will be informed before the completion of the order, where applicable.

Examples of remote national locations include:

  • smaller islands

  • lagoons

  • postcodes in mountainous areas not ordinarily served by express couriers

In such cases, any return or size exchange costs can be quantified at €19.00.

Modification or cancellation of an already processed order

All paid orders are processed as quickly as possible. If, after the status changes from “payment accepted” to “shipped”, the customer requests cancellation or modification of the order, €5.00 will be charged for handling and shipping.

Non-compliant return

Devid Label reserves the right to withhold €25.00 per item in case of non-compliant returns, for example, in the presence of:

  • absence of protective bags

  • missing packaging

  • damaged items

  • conditions that prevent resale of the product

3. Payments

Devid Label accepts various payment methods, including:

  • credit card

  • bank transfer

  • PayPal

  • Scalapay

  • cash on delivery

  • Google Pay
  • Klarna
  • Apple Pay
  • Shop

Devid Label reserves the right to refuse certain payment methods or require others for specific orders.

The customer is responsible for any costs associated with the bank transaction.

4. Use of promotional vouchers

Promotional vouchers cannot be purchased, but are issued by Devid Label as part of promotional campaigns and are valid for a limited period.

Promotional vouchers:

  • can only be used once per order

  • cannot be used to purchase gift vouchers

  • may be subject to a minimum spending threshold

  • are not convertible into cash

  • do not accrue interest

  • are not transferable to third parties

  • cannot be applied retroactively

Unless otherwise indicated, it is not possible to combine multiple promotional vouchers on the same order.

If, following a return, the final value of the order is less than the threshold required for the voucher used, Devid Label reserves the right to charge the original price of the products retained by the customer.

5. Use of gift vouchers

Gift vouchers can be purchased and used exclusively for the purchase of products, but not to purchase additional gift vouchers.

If the value of the voucher is not sufficient to cover the entire amount of the order, the difference can be paid using one of the accepted payment methods.

Gift vouchers:

  • must be used before placing the order

  • are not convertible into cash

  • do not accrue interest

To check the balance or manage a gift voucher, the customer can access the “My account” section of the website.

6. Right of withdrawal

The customer has the right to withdraw from the contract without giving any reason, within 14 days of receiving the products.

The right of withdrawal is excluded for sealed products that are not suitable for return for hygienic reasons or health protection, once opened after delivery, such as cosmetic products for body care and beauty.

If the customer wishes to return one or more purchased products, Devid Label can arrange collection via its courier, without the need to print labels.

Information on the right of withdrawal

The withdrawal period expires after 14 days:

  • from the day on which the customer, or a third party designated by them other than the carrier, acquires physical possession of the goods

  • or, in the case of multiple orders with separate deliveries, from the day on which they acquire possession of the last good

The communication can be sent via an explicit declaration, also by e-mail. A standard withdrawal form can be used, but it is not mandatory.

If the withdrawal is sent via the website or by e-mail, Devid Label will immediately send a confirmation of receipt on a durable medium.

Effects of withdrawal

Following withdrawal, Devid Label will reimburse all payments received from the customer, with the exception of any additional costs related to special shipments or deliveries outside the Italian territory, within 14 days from the moment it is informed of the decision to withdraw.

The refund will be made using the same payment method used for the purchase, unless otherwise agreed.

The refund may be suspended until the goods are received or until the customer proves that they have returned the products, if earlier.

The customer is required to return the products within 14 days of communicating the withdrawal.

Products must be returned:

  • correctly packaged

  • in their original or equivalent packaging

  • complete with any accessories, instructions, and documentation

  • with a document useful for identifying the order

  • without signs of use exceeding a normal trial of the product

In case of loss of the original packaging, the customer must provide a suitable replacement to allow for the return.

The customer is responsible for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics, and functioning.

Withdrawal will not be effective if the returned product does not comply with the conditions indicated above or if it falls within the exceptions provided by law.

Standard withdrawal form

The customer can exercise the right of withdrawal using the form available on the portal, or through any explicit declaration containing at least:

  • order number

  • address

  • any IBAN for reimbursement, if necessary

In case of an order cancellation request before delivery, any bank fees incurred by M.A.R.E. SRL will not be reimbursed, as well as any ancillary costs incurred, for example for gift packaging.

Returns must be shipped within 7 days of the return request and/or receipt of the waybill.

7. Refunds

Purchase receipts may be issued in electronic or paper format.

Refunds will be credited directly to the account or payment instrument used for the purchase:

  • for payments via bank transfer, to the originating account

  • for payments via PayPal, credit card or Scalapay, to the respective account or original circuit

8. Customer service

For any information, the customer can consult the help page of the website or contact customer service.

9. Guarantee for defects and non-conformities of products

Purchases made on Devid Label are subject to the provisions of the Consumer Code regarding the legal guarantee for defects and non-conformities of products.

The customer may therefore exercise the rights provided by art. 130 of the Consumer Code within the terms established by art. 132 of the same decree.

These General Terms and Conditions of Sale can be consulted on the website www.devidlabel.com and can be saved or printed using the normal browser functions.

Order details and a copy of the General Terms and Conditions of Sale may also be archived by the customer via the automatic order confirmation email sent by Devid Label.

10. Applicable law and competent court

These General Terms and Conditions of Sale and the sales contracts are governed by Italian law, with particular reference to the Consumer Code and Legislative Decree 70/2003 regarding electronic commerce.

For any disputes, the customer may resort to out-of-court resolution procedures in accordance with articles 141 et seq. of the Consumer Code.

Devid Label guarantees its participation in any amicable settlement attempt promoted before RisolviOnline, an independent and institutional service provided by the Arbitration Chamber of the Bologna Chamber of Commerce.

The customer also has the right to access the European platform for online dispute resolution.

For any judicial dispute arising from these General Terms and Conditions of Sale or from sales contracts, the Court of Bologna shall have exclusive jurisdiction, without prejudice to the inalienable rights recognized to the consumer by current legislation.
